According to testimonies of the victims, about 71 people lost their job and are private of their allowances of exit by the temporary president. To believe the victims, "this dismissal intervenes in violation of the provisions of articles 158 of the Constitution and 9 of the organic law on the higher Council of the magistrature because as temporary, he does not have the full powers to act like chair of constitutional Court and president of the higher Council of the magistrature in order to carry out nominations", they declared.

This decision of the temporary president of the constitutional Court would be made, according to certain sources of the high court, in order to lead an investigation into the management of Benoit Lwamba, because, the source continues, of the "strong allegations of diversion of the public money would weigh on him".

It should be recalled that, the former president of the constitutional Court had resigned at the head of this institution of the State, a resignation confirmed by the Presidency of the Republic. Thus new temporary judge Funga was appointed while waiting for the appointment of new 1st aforesaid president of the Court by presidential order.
