The Kinshasa deputies have been invited to led an inquiry against the governor in the Provincial Assembly to take the justification for his decision.
It appears that the governor of the city of Kinshasa has made appointments and permutations of mayors and their deputies.
The vice president of Bokeseni platform, Aron Kazadi, announced that the governor of Kinshasa city Gentiny Ngobila, breached the law by appointing and permuting the mayors and their deputies. He thereby breached the law.
The platform pointed out that the constitution of the Democratic Republic of Congo does not give any power to permutate, even less, to appoint the mayors and their deputies to the governor.
The text formally states that the mayor is appointed on a provisional basis by the president of the Republic on proposal of the Minister of Home Affairs.
The platform also pointed out that in public law, the jurisdiction of attribution makes it possible to denounce the illegal and unconstitutional nature of this decree by the governor of the city of Kinshasa.
It regards this as a deliberate act of sabotage of the institutions of the republic and fears that other governors may follow the example by using this decree as case law. Bokeseni notes that he is afraid that the victims of yesterday were trying to become institutional assassins today.
The Bokeseni platform, through this statement, reminds the governor of the city that Article 135 bis of the Congolese Criminal Code provides that any person who provoked directly and disobeys the laws of the Republic will be punished by penal servitude and Calls on the provincial deputies to strictly respect the rules of the rule of law and democracy by peacefully appealing to the governor on the motivation of this decree.
She also exhorted to the President of the Republic, Félix Antoine Tshisekedi, guarantor of institutions to make effort to put an end to the disorders created by the publication of this decree. According to Article 27 of the constitution, the Bokeseni platform will be obliged to act in defense of the rule of law and democracy.
