Me Omondjo Wandjowo, lawyer at the Kinshasa Bar / Gombe said Wednesday at the courthouse that the 4th hearing on the case of the spoliation of the concession of the Congolese News Agency (ACP) initially planned for 14 August 2019, is postponed to October 30 for lack of exchange of exhibits and pleas that the respondent has not yet submitted to the court.

According to ACP’s counsel, the procedure is proceeding as it was intended that the parties could exchange their evidence and pleas.

"The Boaz Panzu party should file the evidence before the court from which the debate is going to take place in order to examine it, and we, too, will do the same, before coming to plead before the judges," he explained. This duty, he said, not having been fulfilled yet, the appellant requested a remission to make this exchange of documents and submissions because it was the respondent who won the first degree judgment present his exhibits first and the appellant party concludes and advance the file.

"As the next hearing falls during Judicial Vacations, the Court sent us back on October 30, 2019 to complete the procedure by exchanging the documents and the conclusions between the parties if the duty is fulfilled, we will plead otherwise the law gives us the possibility of summoning the other party which is slow to put the case in order to be compelled by law to come and plead for a useful hearing, "he said, before continuing. "We are not going from a hearing to a hearing, the law gives us the opportunity to judicially summon the respondent to compel her to do this duty"

The custodian of real estate titles, revealed Mr. Omondjo, is also a party to this lawsuit because, it is him who established the certificates of registration of the ACP and Boaz Panzu on the same bottom, the parcel occupied by the ACP for more than 40 years. It is therefore surprising to see a person in 2014 claiming to have obtained the document from the judgment of the high court that confirmed the sale that would have occurred between Boaz Panzu and James Lopez, Swiss nationality who would have sold him some of the ACP's concession.

Moreover, in criminal the Kinshasa / Gombe High Court rejected on Wednesday, the appeal filed by the Boaz Panzu party and returned the case to the court of peace / Ngaliema for the continuation of the trial.
