As interim Prime Minister, Deputy Prime Minister in charge of Transport and Communications, José Makila, had submitted a request for interpretation to the State Council. "I asked for the opinion, I say the opinion of the High Court; because we are 28 members of the government who have given up our ministerial duties. And we cannot leave the ministries without the transfer of the power", José Makila Sumanda explanied.

In each ministry, according to him, there are hot files of the republic, files in progress, which must be managed with responsibility. "If the Council of State finds that we must leave departments like this, there is no problem, we will comply with what the Council of State will say", he let know.

In addition, Makila Sumanda said, the government has not yet resigned, because the Prime Minister has not yet submitted his resignation.

Respect of the constitution


The opinion of the Council of State should not be contrary to the provisions of the constitution, argues for its part Jean-Louis Esambo, professor of constitutional law, saying that the resigning ministers should only deal with current bussiness.

"If they have taken the option for an elective office, it has a political and constitutional consequence. The consequence is that they have to resign as members of the government because they cannot cumulate an elective office with a political office.
